Welcome to ppetitan.com, operated by TVE, INC. ("we," "us," or "our"). TITAN PPE and FENNEC are brands and trademarks of TVE, INC. By accessing or using this site, purchasing from us, or using any of our services, you agree to these Terms of Service ("Terms"). Please read them carefully. If you do not agree, do not use the site.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, to use this site and to purchase products. Certain products, including knives, may only be sold to adults, and we may request age verification.
2. Products and information
We work to keep product descriptions, specifications, images, prices and availability accurate. Specifications such as lumen output, runtime and beam distance are measured under test conditions and may vary in real-world use. Colors and finishes may vary slightly due to manufacturing and display differences. We may correct errors, update information or limit quantities at any time without notice.
3. Lawful and safe use
You are responsible for using our products safely, for their intended purpose and in accordance with the included instructions, and for complying with all laws that apply where you live, including laws regarding the carry, possession, import and use of knives, tools, lighters and other equipment. Respirators, gas masks and filters must be selected, fitted, used, stored and replaced according to the manufacturer's instructions. No product guarantees protection against every hazard. Batteries must be charged, stored and handled following the included instructions. Do not recharge non-rechargeable batteries.
4. Orders and payment
By placing an order, you confirm that you are authorized to use the payment method provided and that the information you give us is accurate and complete. Placing an order is an offer to purchase; we may accept, refuse or cancel any order, including in cases of suspected fraud, pricing or listing errors, or limited stock. If we cancel an order after payment, we will refund you in full. Prices are listed in U.S. dollars and do not include applicable taxes or shipping unless stated.
5. Shipping and delivery
Shipping options, rates and delivery estimates are described in our Shipping Policy and shown at checkout. Delivery times are estimates and are not guaranteed. We remain responsible for your order until it is delivered to the address provided at checkout. If an order is lost or damaged in transit, contact us so we can investigate and arrange an appropriate replacement or refund. For address errors or delivery disputes, we review the circumstances with you and the carrier. Nothing in this section limits rights available under applicable law.
6. Returns and refunds
Returns are accepted within 30 days of delivery, subject to the conditions in our Return Policy, including product-specific rules for filters and gas masks.
7. Warranty
Our products carry the written warranty stated for the applicable product. FENNEC knives have a limited lifetime warranty. FENNEC flashlights have a five-year limited warranty. Separate batteries and included accessories are covered for one year unless the applicable product warranty states otherwise. Coverage for an internal, non-user-serviceable battery follows the applicable product warranty. The TB-11 respirator has a one-year limited warranty; consumable filters are excluded from that written warranty. These Terms do not disclaim applicable implied warranties or reduce rights and remedies that cannot be excluded by law. Warranty coverage and statutory rights are separate from our change-of-mind return policy.
8. Intellectual property
All content on this site, including the TITAN PPE and FENNEC names and logos, product names, designs, images, graphics and text, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute or use our content without our written permission, except as permitted by applicable law.
9. Prohibited conduct
You may not use the site for fraudulent or unlawful purposes, interfere with its operation or security, upload malicious code, or misrepresent yourself as an authorized representative of TVE, INC., TITAN PPE or FENNEC.
10. Limitation of liability
To the extent permitted by applicable law, TVE, INC. is not liable for indirect or consequential losses that were not reasonably foreseeable when an order was accepted. This exclusion does not apply to liability arising from fraud, willful misconduct, gross negligence, death or personal injury caused by our negligence, or any liability that cannot lawfully be excluded or limited. Nothing in these Terms limits our written warranty obligations or your nonwaivable consumer rights. Where applicable law does not permit an exclusion, that exclusion does not apply.
11. Indemnification
To the extent permitted by applicable law, you are responsible for third-party claims directly caused by your unlawful conduct, intentional misuse of a product or material violation of these Terms. This provision does not require you to indemnify TVE, INC. for its own negligence, misconduct, defective products or breach of legal obligations.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Subject to any mandatory rights to bring proceedings elsewhere, disputes may be brought in the state or federal courts located in Los Angeles County, California. These Terms do not deprive consumers of protections provided by laws that apply regardless of a choice-of-law provision.
13. Changes to these Terms
We may update these Terms from time to time. Updated Terms apply prospectively from the date posted. Orders already accepted remain subject to the terms provided at purchase unless a change is required by law or agreed with you.
